Once you have received a Primary Entry, you will be provided a unique link which you can use to gain bonus entries. To earn bonus entries, share your unique link with a family member or a friend and if they submit their own Primary Entry using your unique link (a “Referral Entry”), subject to successful moderation, you will receive one bonus entry (“Secondary Entry”). FULL TERMS AND CONDITIONS


1. This Promotion is open to residents of the United Kingdom aged 18 or over, excluding employees of the Promoter, its agents and anyone professionally associated with this Promotion.


2. No purchase necessary; however, internet access, photograph submission, email address, mobile number and a valid UK bank account are required.


3. Promotion Period: Enter between 00:01 BST on the 22nd July 2024 and 23:59 BST on the 26th August 2024 inclusive, or until the first 499,000 submissions have been manually moderated.


4. To Enter:

  • Visit myera.cadbury.co.uk during the Promotion Period, complete the online form providing your details (full name, email address and mobile number), verify your mobile number and upload a photo of your face, which will be merged by AI into a historic Cadbury advert and be moderated. Subject to your photo being within the first 499,000 images submitted and also successfully passing the moderation process, this will earn you 1 entry into the Prize Draw (“Primary Entry”).
  • Once you have received a Primary Entry, you will be provided a unique link through which you can use to gain bonus entries. To earn bonus entries, share your unique link (“Referral Link”) with a family member or a friend and if they submit their own Primary Entry using this link (a “Referral Entry”), subject to successful moderation, you will receive one bonus entry (“Secondary Entry”). You can receive a maximum of 5 Secondary Entries via this route.


5. Further Entry Details:

  • Primary Entries will be weighted equally to Secondary Entries in the Prize Draw.
  • You must only submit a photo of your own face. Photos of anyone else or anyone under the age of 18 will be disqualified.
  • Photos submitted must comply with the Image Requirements stated in clause 6.
  • Mobile phone number verification will be used in order to limit the number of entries.
  • Entrants should be aware that AI has been used in the development of the Cadbury AI tool.
  • Entrants agree to grant the Promoter in perpetuity a sole, non-revocable, worldwide, royalty-free licence to use the copyright and all other intellectual property rights vesting in their entry for all purposes connected with this Promotion, including but not limited to: display on the Promoter’s website, social channels, in any publicity, advertisement or case study carried out by or on behalf of the Promoter in any manner or medium whatsoever, including print, broadcast or the internet and any other website of the Promoter or its agents/contractors choosing and use of the submission, or part(s) of the submission in marketing materials relating to this Promotion. Entrants are permitted and encouraged to share their entry on social media and with friends/family.
  • Each entrant also grants the Promoter and its agents/contractors the right to moderate, edit, modify or remove any submission in the Promoter’s, it’s agents or assignees’ sole discretion, in whole or in part, for display on the Promotion website or in any materials relating to the Promotion.
  • Entrants agree to the inclusion, publication, reproduction and/or other use of their entry by the Promoter in any form of media.
  • If an entrant’s photo does not pass moderation, their photo and any data related to it will be deleted once the moderation process has been completed and the Promotion is fulfilled, in accordance with our Privacy Policy at https://eu.mondelezinternational.com/privacy-notice.
  • All posters and related data will be deleted within 4 weeks from the end of the Promotion Period, in accordance with our Privacy Policy.


6. Image Requirements: Photos submitted must:

  • Display your face in a front-facing orientation.
  • Be clearly focused and unobstructed.
  • Be taken in a well-lit environment without shadows.
  • Be taken on a modern device with a high-resolution camera.


7. Maximum of 1 Primary Entry is permitted and a maximum of 5 Secondary Entries are permitted per person during the Promotion Period. No person may win more than 1 Primary Prize and 1 Referral Prize.


8. The Prizes:

  • Primary Prize: There will be a total of 25 Primary Prize winners. Each Primary Prize winner will win 1 x £200.
  • Referral Prize: There will be a maximum of 125 Referral Prize winners. Each Referral Prize winner will receive 1 x £200.

9. Further Prize Details and Conditions:

  • Winners will receive their £200 via BACS.
  • Winners are responsible for providing correct bank account details and the Promoter will not be liable for any Prize payments made into the wrong bank account.
  • Winners must have a valid UK bank account.


10. Winner Selection: 25 provisional Primary Prize winners will be randomly selected from all valid entries received during the Promotion Period. For your total confidence, the Prize Draw will be conducted by PromoVeritas, the independent promotional verification service, within 5 working days of the end of the Promotion Period. If a provisional Primary Prize winner received up to 5 Secondary Entries through their Referral Link, each entrant who submitted a Referral Entry will be deemed a provisional Referral Prize winner.


11. Winner Notification: Provisional winners will be contacted via the email address provided on entry within 5 working days of the Winner Selection and will be asked to provide evidence of identity and eligibility. Reasonable efforts will be made to contact the provisional winners. Once eligibility has been confirmed, the provisional winner will be confirmed as a winner. If a provisional winner does not respond to the initial contact within 14 days, we reserve the right to disqualify that entrant and award the Prize to a reserve selected in the same manner. Reserve winners may have less time to respond.


12. Prize Acceptance: Fulfilment of the Prizes will take place within 28 days of acceptance of the Prizes. In the unlikely event that a Prize does not arrive within 28 days, the winner must inform the Promoter by emailing mycadburyera@promowinners.com. If a winner does not do so, the Promoter reserves the right to not reissue the Prize at its sole discretion.


13. Moderation: The Promoter reserves the right to reject entries which, in the reasonable opinion of the Promoter:

  • are in breach of the Terms & Conditions;
  • contain any content that is offensive, harmful, objectionable or which is otherwise unsuitable for publication including with respect to race, religion, origin or gender, or which could reflect negatively upon the name, reputation or goodwill of the Promoter or any brand partner;
  • contain an inappropriate image which has been created by the AI tool as a result of the submission inputted;
  • contains or refers to any unauthorised third-party brand or references any third-party names, logos and/or trademarks;
  • promotes any political agenda;
  • contain defamatory, malicious, indecent or other inappropriate content including sexist or racist language or imagery;
  • include the names, likenesses, photographs or similar of any individual without their express permission;
  • contain immoral or obscene behaviour;
  • condone or encourage violent or anti-social behaviour;
  • cause offence on the ground of religion, gender, sexual orientation, nudity, disability or age; or
  • represent a danger to health and safety or cause fear or distress.


14. Provided no objection is received, the surname and county of the winners will be made available to anyone who requests them by writing to JS14659 Cadbury AI Memory Maker, PO Box 704, Pinner, HA5 9PF, within 3 months of the closing date. In the event they win, winners may request that their surname and county are not published or request for the amount of information being published to be reduced during the Winner Notification process. Without prejudice, the Promoter will provide this information to the Advertising Standards Authority on reasonable request.


15. The Promoter may request that the winners participate in publicity arising from the Promotion. Participation is at the winner’s discretion and is not a condition of Prize Acceptance.


16. The Promoter seeks to run a fair and secure promotion and prevent abuse and cheating. If you enter in a way that is not consistent with these Terms & Conditions, your entry/ies (and any of your associated aliases) will be disqualified. Any Prize awarded may be void and recoverable, and the Promoter reserves the right to bar you from entering future promotions for a period of at least six months. For this reason, the Promoter reserves the right at any point to:

  • Verify the eligibility of entrants and/or provisional winners through multiple means by requesting such information it considers reasonably necessary for this purpose. Entry or a Prize may be withheld until verification is completed.
  • Disqualify entries that are not made directly by the individual entering the Promotion.
  • Disqualify entries made using anonymous email services such as, but not limited to, GuerillaMail, Dispostable or Mailinator.
  • Disqualify bulk entries from individuals, trade, consumer groups or third parties, incomplete entries and entries submitted by macros or other automated means.
  • Disqualify entries beyond the maximum allowed, or those using techniques such as ‘script’, ‘brute force’, using multiple SIM cards for mobile number verification, masking identity by manipulating IP addresses, using aliases or identities other than their own or any other means.
  • Disqualify entrants who tamper with the entry process.
  • Disqualify entries which, in some other way, do not meet the requirements of these Terms & Conditions.
  • Cancel, modify or suspend the Promotion should it not be capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, dishonesty, technical failures, or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion.


17. The Prizes are not transferable or exchangeable and cannot be redeemed for any other form of compensation. If for any reason a Prize is not available, the Promoter reserves the right, at its sole discretion, to substitute that Prize for another of equal or greater value.


18. No responsibility can be taken for entries which are lost, delayed, corrupted, damaged, misdirected or incomplete or which cannot be delivered for any technical, delivery or other reason. Proof of sending will not be accepted as proof of receipt. The Promoter does not guarantee continuous or secure access to myera.cadbury.co.uk.


19. The Promoter and its associated agencies and companies are not liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Promotion (JS14659) or accepting or using the/a Prize(s), except for any liability which cannot be excluded by law. Nothing will exclude the Promoter’s liability for death or personal injury as a result of its negligence.


20. The Promoter will not be liable for any delay or failure to comply with its obligations for reasons beyond its reasonable control arising from but not limited to Acts of God, global or regional epidemic or pandemic, adverse weather conditions, fire, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, civil commotion, plague or other natural calamities, or any other circumstances.


21. The Promoter shall comply with all applicable requirements of the Data Protection Act 2018, the General Data Protection Regulation 2016 and any successor legislation or other applicable law. The personal information entrants provide will be used by the Promoter for the purpose of conducting this promotion and in accordance with the Promoters’ Data Privacy Notice which can be found at https://privacy.mondelezinternational.com/eu/en-gb/privacy-notice/. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this Promotion (including any relevant promotional activity) or communicating with entrants.


22. If any part/s of these Terms & Conditions are legally ruled to be invalid, illegal or unenforceable, the remainder will not be affected and will continue in full force and effect.


23. By entering, you will be deemed to have agreed to be bound by these Terms & Conditions.


24. If there is a discrepancy between these Terms & Conditions and those in any promotional material, these Terms & Conditions will prevail.


25. These Terms & Conditions are governed by English law and their interpretation and application will be subject to the non-exclusive jurisdiction of the courts of England and Wales. Residents of Scotland and Northern Ireland may bring proceedings in their own jurisdiction.
